上次說到sony不願意履行協調書上寫的「無條件」更換新機給我 所以我去地方法院申請了民事訴訟 由於是第一次寫這種「狀紙」所以根本不懂，我便詢問了一下服務人員， 服務人員說因為是sony不願履行合寫書的內容，所以我要請法官強制要求他們履行內容 說真的，我現在根本不想要拿到新手機，我只想拿到「錢」 因為我不想再拿一個爛廠牌的爛手機，我只想拿他們賠給我的錢去買別廠牌的手機 至少我不用再受這一堆的鳥氣 但當初協調書上寫說是無條件換新手機，那我也只好在狀紙上寫 「被告sony須履行協調書內容換同型號手機給原告」 之後乖乖去繳費台繳一千塊訴訟費 為了一支原本sony該無條件換給我的手機，我已經先賠了「一千塊錢」 於隔日，sony客服又打了通電話給我，她廢話說很多 我將內容簡單做了個小整理 「她請我將手機讓他們公司收回去檢查，如果手機檢查後確實有問題的話， 她會盡她最大的努力跟公司建議換一支新手機給我。」 以下內容我以對話方式呈現 我：「盡最大的努力？如果努力沒成功怎麼辦？」 (真好笑，我是不是該感謝妳這麼努力幫我啊？) 客服：「我會盡我最大的努力幫你爭取換新手機。」 我：「所以我問如果你盡力了，還是不換怎麼辦？如果檢查說手機是好的， 那又怎麼辦？你們還願意換嗎？」 客服：「我無法回答假設性的問題，也不要先預設情況，我會盡我最大的努力。」 我：「我就是被你們公司騙了這麼多次，所以我要將可能性全部都假設好。」 我搞不懂，是他們看不懂國字，還是讀書時國文這堂課根本被當掉了 那份有他們公司人員簽名的協調書上就寫「無條件」更換手機給消費者 為什麼我要換手機還要經過他們檢查有問題才要換 如果是要收檢查手機有沒有摔機或受潮，這我同意 但他們根本不是檢查這兩項 我一直跟他們強調 「你們將新手機準備好送去新竹站，我再拿我的手機去新竹站給你們檢查 有沒有受潮和摔機，確定手機正常，我當場將新手機拿走。」 這才是我能接受的無條件換新手機 於上上星期一時，我主動和蘋果日報連絡，因為我太不爽了 我打算公諸媒體，當天下午蘋果開了三方通話 蘋果請我問sony「為什麼不願意按照協調書上寫的無條件換新機？」 客服還是不改回答的內容 「我們要經過檢查，確定手機有問題，我會盡最大的努力向公司建議 你要求換新機的要求。」 我：「如果檢查說沒問題勒？這樣你們還要換嗎？」 客服：「我無法回答假設性的問題。」 蘋果有請我順便問說當初跟我開協調會的那位先生的職位 結果客服說：「這我不方便透露。」 由此可見sony處事風格怎麼樣，就不用我多說了吧 上星期三時我收到地方法院寄來的通知書，請我補一些被告(sony)的資料 由於有許多資料我根本不知道該怎麼填寫，只好請假跑法院一趟 地方法院服務人員請我詢問sony公司 我也異想天開的打電話去sony詢問公司負責人的大名 當然得到的答案是「不方便透露」 我居然傻傻的打電話過去以為他們會跟我說 最後我是在經濟部公司登記網站找到了我要的資料 在昨天蘋果跟我通過了電話，表示sony公關部經理想與我聯絡，問我方便嗎 我當然方便阿，有人願意出來解決這件事當然是最好阿 誰知道，從昨天等到了剛剛，所謂的「公關經理」根本沒有打電話過來給我啊 我只好再度向蘋果聯絡，表示sony沒有打電話來 並詢問蘋果sony是怎麼解釋不換手機給我的原因 蘋果：「sony說他們要檢查手機確定有問題他們才要換新機。」 我：「確定有問題才要換？」 蘋果：「我知道你的疑問點是既然是無條件，為什麼要檢查有問題才要換？」 這麼簡單的問題，記者都知道了，難道sony不知道嗎？ 所以當初協調書上寫的「無條件」這三個字是放屁囉 教育部查到的解釋是 無條件：不附加任何條件 而sony現在是要附加「檢查確定有問題才要換。」 sony國文真的有待加強 在今早收到了地方法院的通知單 請我補齊其它資料(負責人戶籍謄本、公司登記卡) 搞不懂這些東西都是被告(sony)的資料 怎麼不叫被告在開庭時自己帶來，而是我這個原告該去準備 民事訴訟真的是一條非常艱辛的路 要不是遇到這種惡質公司，我也不會走向這條路 到後面我花的時間跟金錢，肯定遠遠超過這隻手機的價值 我很想要求他們直接退我錢，但我當初去中華電信續約時 為了讓手機價錢壓低，我選擇高費率的方案 想說我會努力的打電話來讓月租費繳的有價值 如果他們到時要求只賠我續約時手機的機子錢 那我不是損失的更多 反倒是這個時候如果我要求他們賠我手機空機時的價錢 那他們又可以反咬我ㄧ口敲竹竿 變成我只能依照協調書上寫的「無條件換新機」的要求 可是我不想要再用爛廠牌的爛手機了 等出問題時還要面對他們的爛服務 -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 114.37.132.160

標題[問題] 公司希望搬到附近

小弟我今年7月中退伍後， 找了兩個多月的工作，終於在9月底找到了工作， 有兩份面試，一份是在新莊，一份是在松山， 因一開始先錄取的是新莊的工作，因此便搬到了新莊(民樂街) 在這份工作要上班前幾天，後來松山(塔悠路)的工作也發了錄取通知， 經我考慮後便決定到松山去工作， 工作時間是9:00~18:00，因為是做手機網拍的工作，因此也會有加班的時候， 因此從9/30到今天10/10扣掉周休二日和國定假日， 每天就差不多就從新莊騎30~35分鐘的車到松山去上班， 因為公司規模不大，會計小姐也有兼HR， 她說她以前住土城也是這樣通勤上班一年，但她是坐車從土城到松山， (我也沒問為什麼不騎車) 她建議我跟新莊這裡的房東說看看能不能退租，搬到台北市至少離公司近一點的地方， 我看合約是寫如在合約間退租需賠償一個月押金，(但詳細還是要問房東看看) 請問各位如果有確定要在這間公司定下來做長久的話，會有考慮要退租搬家嗎? -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 123.0.49.194

【李忠謙／綜合外電報導】阿根廷總統費南德茲（Cristina Fernandez）昨（8日）完成腦部手術，成功去除頭蓋骨下的血塊。政府發言人表示，手術一切順利，總統還留在加護病房治療，但沒有任何併發症。

費南德茲5日到醫院檢查時，發現顱內出血，醫生下令休假一個月。現年60歲的費南德茲，其實早在8月時不慎跌倒撞到頭，但當時醫生檢查後稱並無大礙，但費南德茲仍感到不適，才發現顱內出血，加上左臂已出現無力症狀，醫療團隊才決定為這位女總統動手術。

　　於 10 月 9 日至 10 月 22 日期間，遊戲內將出現一個神祕的副本「雙十魔女塔」，塔中關著一位楚楚可憐的 5 星魔女「雙雙兒」。玩家只要勇闖雙十魔女塔並通過 30 層關卡，就可以營救雙雙兒並將她收歸於自己的麾下，累積通關層數還可以獲得排行榜獎勵。

標題[問題] HTC NEW ONE電量問題

我這隻NEW ONE是大約今年五月購入的。 紫光問題也是最近在中秋節暗暗的拍照才發現， 不過這不是主要困擾我的地方，最困擾的是蓄電量！ 最近幾個月來，晚上充滿電並且開起省電模式(有開3G上網)， 早上起來都會掉個7~8%左右，去上課偶而會開一下遊戲跟網頁 每到下午時就會掉到20%左右，耗電速度實在太誇張了。 當初買前說跟I PHONE5續電量差不多甚至還贏。 某一天我跟拿i5的同學實測，做一樣的事且設定相同，他50%時我已經28%了.. 我背景程式等等幾乎都習慣性會關掉，定位、自動同步全關。 且有用ES殺程式，充電習慣也很良好。 真的不知道問題在哪裡~"~我有抓三方軟體來檢測電量發現手機耗電量 幾乎一半以上都是耗在Android 系統中，這樣是正常的情形嗎? 送修的話，我也想先試著找出問題，他們也比較好處理... -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 61.230.193.242

彭博社報導，美國政府部分停擺已對全球航空業造成影響，包括達美航空（Delta AirLines Inc.）和AMR集團（AMR Corp.）旗下美國航空（American Airlines）等新噴射機目前滯留遠達德國等海外地區等待運交。

1架空中巴士（Airbus SAS）A319飛機訂今天運往美國，目前仍停留在地面等候指令，和其他空巴噴射機一樣滯留歐洲，無法交付捷藍航空（JetBlue AirwaysCorp.）和全美航空集團（US Airways Group Inc）。

儘管空中旅行還未受到影響，但航空公司和飛機製造商出貨遲緩，已顯現美國聯邦政府停擺效應。

美國通用航空製造商協會（General AviationManufacturers Association，GAMA）指出，小型飛機也恐將受累，因為政府關閉至10月中旬，將在飛機運交旺季期間，延誤價值15億美元、130架飛機運交。

前空巴主管、現為韓林運輸顧問公司（HamlinTransportation Consulting）總裁韓林（GeorgeHamlin）表示：「我們從未遇過這種事。大家都忙於應付政府關閉影響，它終將對所有事務都產生衝擊。」

成員包括波音公司（Boeing）商用機事業和德事隆集團（Textron Inc.）的美國通用航空製造商協會指出：「政府關閉拖得愈久，愈有可能造成經濟難題和工作流失。」
